Foreclosure OffenseTM refers to a broad range of actions that can be brought against a bank, either as a counterclaim to a foreclosure action already filed by a bank or as an independent action. Depending on the factual circumstances, such actions may be statutory (such as Truth In Lending Act or Fair Debt Collection Practices Act claims) or based upon the common law (such as fraud or tortious interference with business relationship claims).
