Because foreclosure is a rapidly developing area of the law, trial judges are often asked to decide new issues where there are little or no previous decisions from appellate courts to provide the judge with guidance as to how he or she should rule. As a result, the foreclosure defense attorney must be prepared to seek appellate review of decisions along the way or at the end of the case.
